Delivery service seeks court OK for protocol to deliver furniture to Mitchell Gold clients

Court sets Jan. 24 deadline for objections to the motion and will hold a hearing on Jan. 31

WILMINGTON, Del. — A Maryland-based delivery service has requested approval to establish a process to deliver furniture that Mitchell Gold customers have been waiting to receive in the months leading up to the company’s bankruptcy filing last September.

Need It Now Delivers, along with several affiliate delivery services, filed a motion with the U.S. Bankruptcy Court for the District of Delaware on Jan. 17 to deliver furniture to customers that have paid for the finished goods and who have not received a refund for those items.

The company said it is storing 3,600 individual furniture pieces in its warehouses in St. Louis, Missouri; Oak Brook, Illinois; Chicago; Baltimore and Atlanta. About 1,400 pieces have been assigned to various Mitchell Gold customers.

The company noted that similar protocols have been established with Ryder Last Mile Inc., which received court approval to deliver finished Mitchell Gold products to paying consumers last fall.

As part of the delivery protocol, NIND is asking for access to a database of the names and addresses of customers who have paid for the furniture and are still awaiting delivery.

It also is asking the end customers to provide information on a request for delivery form that details their purchases along with other information including their name and address, order number and amount paid, along with the payment method for the furniture.

It would then send this information to the appropriate credit entities to verify the accuracy of the customer’s information and also ensure that the customer has not requested nor obtained a chargeback, credit or refund.

The court has set a deadline of 4 p.m. Jan 24 for objections to the motion and has scheduled a hearing on the motion for 10 a.m. Jan. 31 at the courthouse in Wilmington, Delaware.
