by WASHINGTON, D.C. — The United States International Trade Commission has voted to institute an investigation of certain Chinese-made pillows, seat cushions and components and packaging requested by mattress manufacturer Purple Innovation.
As previously reported by Home News Now, Purple filed its complaint on Aug. 5, which alleged violations of section 337 of the Tariff Act of 1930. These involved the importation and sale of certain pillows, seat cushions and components and packaging that infringe patents, trademarks and trade dress.
Purple also has asked that the ITC issue a limited and general exclusion order and/or cease and desist orders involving the sale of these items into the U.S. market.

The ITC said by instituting the investigation (337-TA-1328), it has not made any decision on the merits of the case.
Its chief administrative law judge will assign the case to one of the agency’s administrative law judges and that judge will hold a hearing related to the matter and then make an initial determination if there has been a violation of section 337.
That decision will be subject to review by the commission and the ITC will then make a final determination. It will set a target date for completing the investigation within 45 days after institution of the investigation.
